Steps to Take
Lawyer Up: It's time to consult with legal experts to get your facility listed in the litigation. This ensures you are part of the process and can receive regular updates on the case.
Determine Eligibility: Assess the types of claims your facility can submit – and keep in mind every plan may have different criteria. Things to consider:
Underpayment Claims: Identify any pricing that falls below what your plan stipulates. This constitutes damage.
Multiplan Priced Claims: Include any claims that were adjusted or negotiated by Multiplan.
Extortion vs. Negotiation: Even if you accepted lower payments, this is considered extortion rather than genuine negotiation.
Data iSight or Viant Payments: If payments were adjusted through these services, you might still be underpaid.
Historical Claims: You can submit claims dating back four years, but it's advisable to consider going back five years. Let the defendants argue about the statute of limitations.
Identify Relevant Payors: Include all payors that have been sending you Multiplan-related payments.
What to Expect
