August 2025: MultiPlan Lawsuit Moves Forward & BCBS Settlement Updates
DOJ Backs Providers in Price-Fixing Case
BCBS Class Action Settlement: Extended Opportunity for Providers
We opened the conversation with updates on the $2.8 billion Blue Cross Blue Shield antitrust settlement, which impacts providers who treated BCBS patients between July 24, 2008, and October 4, 2024. Payouts—split between facilities and individual professionals—are calculated using “Allowed Amounts” submitted or estimated, with no upfront documentation required.
Although the original July 29, 2025, deadline is being extended, the window to participate remains short. Even if you missed the initial date, this settlement matters—it affects pending payments, sets important legal precedent, and offers insight into future class action opportunities.
MultiPlan Antitrust Litigation – DOJ Backs Providers
In this month’s ROC discussion, Matt Lavin, Healthcare Litigation Attorney & Partner at Arnall Golden Gregory, provided updates on the MultiPlan Health Insurance Provider Litigation (MDL No. 3121).
Allegations: MultiPlan—now rebranded as Claritev—and major insurers (Aetna, Cigna, UnitedHealth, Blue Cross Blue Shield) allegedly conspired to underpay out-of-network (OON) claims by outsourcing rate-setting to MultiPlan’s pricing tools (Data iSight, Viant, MARS, ProPricer). Providers claim these tools suppressed reimbursements, shared sensitive pricing data, and imposed uniform caps—amounting to cartel-style price-fixing.
Recent Developments:
DOJ Statement of Interest supports the providers’ legal theory.
June 2025: Court denied motion to dismiss; case now in discovery.
Potential for triple damages under federal antitrust law.
Who May Qualify: Any claim involving MultiPlan—negotiated or otherwise—may be eligible. Providers can check EOBs or billing records for terms like MultiPlan, Data iSight, or Viant. Cases are typically taken on contingency with no upfront cost, and joining does not affect ongoing OON payment rights.
